Filed by Mr. Shubham Kumar Jha, the petition challenges the 25% horizontal imposition of domicile reservation in NLSIU which has received the Governor’s assent on May 04, 2020. Today, before the Division Bench of Chief Justice DN Patel and Justice Prateek Jalan, Advocate Shadan Farasat mentioned that he has moved this petition under Article 226(2) of the Constitution. Mr Farasat also highlighted the example of a similar case wherein the coordinate Bench of the court has stayed the imposition of horizontal domicile reservation in National Law University, Delhi. The court, even before listening to the petition on merits, directed the Registry to list this petition before some other Division Bench of this court in coming days. ‘The matter might get listed tomorrow or day after’, the court said.In March, the Karnataka State Assembly passed the National Law School Of India (Amendment) Act, 2020, which received the Karnataka Governor’s assent on May 4. As per this amendment, NLSIU should reserve horizontally twenty five percent of seats for ‘students of Karnataka’. The amendment inserts the following proviso in Section 4 of the National Law School of India Act :- “Notwithstanding anything contained in this Act and the regulations made thereunder, the school shall reserve horizontally twenty five percent of seats for students of Karnataka.”As per the explanation of this section, “student of Karnataka” means a student who has studied in any one of the recognized educational institutions in the State for a period of not less than ten years preceding to the qualifying examination.” Next Story
Courtesy Jenn Stone(LUSBY, Md.) — It was a freak accident that happened in the blink of an eye for sisters Mariah and Ashley Stone in Lusby, Maryland.“It sounded like an earthquake,” said 15-year-old Ashley. “It’s definitely a sound that I think for both of us, we’ll never forget.”It was an afternoon just like any other. Mariah and Ashley were home alone from school and watching television with their dog, when a tree suddenly crashed through the roof of their family home last Thursday.“Everything fell on top of us, between the tree and insulation and the ceiling,” said Ashley.A tree outside their home had completely uprooted from the ground and fell directly on the Stone’s home.A video captured on the family’s Ring security camera in their living room shows the moment that the tree came crashing through their home. Ashley and Mariah could be heard frantically screaming. In the camera footage, one of the sisters — who immediately called their parents after realizing what had happened — cries on the phone, “A tree just fell on the house!”“I’ve never experienced anything like this,” said their father, Francis Stone. “I don’t wish this on nobody, just the mental part of it all — it’s very draining and I’m at a loss.”Stone, who was at work when the accident happened, said he accessed the Ring camera and saw that there was nothing left of his home.Luckily, both his daughters escaped with minor injuries — and when Stone saw the damage for himself, he realized it could have been worse.“I opened the door, that was what broke me down,” Stone said. “It was pretty bad because I realize how lucky my daughters were.”The family of four is now thanking one special home appliance for breaking the tree’s fall: their refrigerator.“If that fridge wasn’t there — who knows what would have happened,” said Ashley. “The situation could’ve been completely different.”Her sister Mariah, 14, added, “That refrigerator saved our lives.”Despite the structural damage to their home and the mental toll that the event has taken on the family, the teens’ father is proud of how they were able to overcome the situation as a family.“After everything and seeing everything, the girls did a great job, they looked out for each other,” said Stone. “They looked out for our other family member too, which was our dog.”“We’re gonna find a way to come out of this stronger and better,” he added.Copyright © 2019, ABC Audio. Legal Q and AOn 14 Jan 2003 in Personnel Today Previous Article Next Article Comments are closed. Legal Q and A by KLegalQ In the recently published Pensions Green Paper, Simplicity, Securityand Choice, the Government has suggested abolition of compulsory retirement. Will employers now be forced to keep on workers beyond the age of 65? A These proposals, which are likely to become law in December 2006,are the Government’s reaction to the UK’s ageing population and an EU directiveto stop age discrimination. Once in force, employers will not be able to discriminate on the grounds ofage. Staff will then be able to continue working after 65 unless compulsoryretirement can be objectively justified. Unfair dismissal rights will apply toall employees. By 2010, early retirement will not be permitted before age 55 (the currentminimum age is 50). A simplified tax regime will mean the maximum earlyretirement pension will be restricted to around £49,000 per year. No changes are proposed to state pension ages although those still workingwill be encouraged to defer taking their pension until they retire. Q Keeping on employees over the age of 65 will be new territory for mycompany. What are the key issues, particularly with respect to performance, sowe can manage them fairly and will not be open to claims of discrimination? A Employers will need to adopt age-neutral performance management andappraisal systems and adhere to them to objectively justify their treatment ofolder workers. In addition, employers will need to review pay structures,non-pay benefits, redundancy rules and recruitment policies. Indeed, ageistjokes could amount to harassment. Q One of the main headaches in providing a pension is the complicatedsystem of taxation. How does the Government intend to simplify the system? A The Government is rightly concerned about the number of employersterminating their occupational pension schemes and wants to make administrationof these schemes easier. Currently, there are eight different tax regimesdepending on the type of scheme and the date of joining. By 2004, a single, simplified regime will apply to all tax-approved pension schemes and willimpose an individual lifetime funding limit on all tax-approved retirementsavings of £1.4m, of which up to 25 per cent may be taken as a tax-free lumpsum from age 55. Where savings exceed the lifetime limit, the excess will besubject to tax at 33 per cent. Current limits on contributions will also bereplaced with a £200,000 annual limit. Transitional rules will apply so that retirement benefits accrued before thenew tax rules are introduced will be respected. However, the value of thesebenefits may restrict the ability to save towards further pension benefits in atax-efficient manner. The Government has also announced that it wants to work with the insuranceindustry to develop more flexible annuities including value-protected annuitiesthat allow unused capital to pass on to dependents where the pensioner diesbefore the age of 75. Q Is it true employees will be able to draw a pension while continuing towork? A Yes. Employees may start to receive their pensions after age 55,while continuing in employment. This is already the position for personalpension plans, and the the existing rules governing occupational pensionschemes will be relaxed. The intention is to encourage employees to keepworking.
